The director of Florida Commercial Business Advisors stressed that it is worth making investments in the United States because it is one of the main economies in the world and assured that the factors to take into account for this are different.
In the first place, he highlighted the importance of looking at the regulations regarding the withdrawal or transfers of foreign currency abroad in any investment or business environment abroad. "This is what is called exchange regulations."
"The tax and fiscal effects of those investments carried out in the United States should also be observed," Botero said in Al día con Dinero.
The next point is to understand the way that business is going to be done, "in general the recommendation that is made, due to fiscal and tax benefits, is to establish a company."
For the above, he assured that the available options are to create a Limited liability company, which is similar to the simplified stock company in Colombia, or to establish corporations (Corp.), which can be similar to a public limited company.
He warned that “there, unlike Colombia, where a company is registered in a Chamber of Commerce, the registry is state. That is, it can be in the state of Florida or any other ”.
After this, the objective is to obtain a tax ID, which would be the equivalent in the United States to the Tax Identification Number (NIT) in Colombia, and he stressed that "it is not necessary to be an American to establish a company in that country."
Finally, a bank account must be opened at any of the local financial institutions.
The businessman, according to Botero, must be clear about whether he wants to invest or do business. "There is talk of two types of investment, passive, which are in residential or vacation property, and active, which are business."
With regard to this, if a Colombian makes a substantial investment in the United States that is between US $ 100,000 and US $ 150,000, he may apply for an E2 visa, which gives him the possibility to settle in that country together with his family circle, with the condition of working in business.
The other option is to acquire the E1 visa, which exists thanks to the free trade agreement that was signed between both countries. "This is similar to E2, only it is not talking about business, but about a generation of commercial exchange between the United States and Colombia."
